Drug Driving in the UK: Penalties and Defence Options

A Practical Guide to Understanding the Law and Protecting Your Rights

Being accused of drug driving is a serious matter. Whether it stems from prescription medication or illegal substances, the implications can be life-changing. Convictions carry heavy penalties, including driving bans, fines, or imprisonment. They can also affect your career, insurance premiums and freedom to travel abroad.

At Nelson Guest & Partners, we have years of experience defending individuals facing drug driving charges. Our team provides clear advice, tailored defence strategies and the support you need to safeguard your future.

Understanding Drug Driving Laws in the UK

Drug driving is covered under section 5A of the Road Traffic Act 1988. The law makes it an offence to drive if you are:

  • Over the legal limit for certain controlled drugs, or
  • Unfit to drive because of drugs, whether illegal or prescribed.

The law sets strict limits for 17 controlled drugs. These include substances such as cannabis, cocaine, MDMA and ketamine, as well as some prescription medications like morphine or diazepam. Unlike alcohol, where limits are measured by breathalyser tests, drug driving involves blood tests analysed against precise thresholds.

It is important to note that even prescribed medication can put you at risk if levels exceed the legal threshold or if they impair your ability to drive safely.

How Police Test for Drug Driving

If the police suspect you are under the influence of drugs, they may:

  • Conduct a roadside saliva test using a “drugalyser” device to detect cannabis or cocaine
  • Carry out a field impairment test, assessing balance, pupil dilation and reaction times
  • Arrest you and request a blood sample at the station for laboratory analysis

Refusing to provide a sample without a reasonable excuse is itself a criminal offence and can result in prosecution.

Penalties for Drug Driving

The penalties for drug driving are severe and can have lasting consequences. If convicted, you could face:

  • A minimum 12-month driving ban
  • An unlimited fine
  • Up to 6 months’ imprisonment
  • A criminal record noted on your driving licence for 11 years

Beyond the immediate sentence, you may also experience:

  • Significantly higher insurance premiums
  • Loss of employment where driving is essential
  • Restrictions on travelling to certain countries, such as the USA

Defence Strategies in Drug Driving Cases

Every case is different. At Nelson Guest & Partners, we assess the evidence in detail to identify weaknesses in the prosecution’s case. Possible defence strategies may include:

  • Procedural errors – mistakes in the way roadside or blood tests were conducted
  • Faulty equipment – challenging the reliability or calibration of testing devices
  • Prescription medication – where legal use has been misinterpreted as impairment
  • No evidence of impairment – demonstrating that your driving was not affected, even if a substance was present in your system

We also work with toxicology experts who can provide independent analysis of blood results and highlight possible inaccuracies.
